The Financial Penalties for Non Compliance Explained.
Since our last news in respect of the potential for fines for those landlords and agents that are marketing commercial property without the benefit of a commercial energy performance certificate we have received a number of e-mails asking for clarification.
Basically if you have a commercial property on the market and you do not have an energy performance certificate to accompany the sales and marketing details then you could be liable to a financial penalty.
It is the Trading Standards Office who are policing this legislation and the fines that can be levied are set out in the government paper relating to commercial energy performance certificates. We have a copy on the Home Page of this web site.
The fines can be as low as £500 or upto 12.5% of the rateable value of the property to a maximum of £5000.
We trust that this clarifies this matter however if you require further guidance please either telephone or e-mail our offices.
